GENERAL TERMS AND CONDITIONS OF SALE
Article 1 – GENERAL PROVISIONS
These General Terms and Conditions of Sale apply exclusively to the online sale of products offered by Bonsoirs Home via the website www.bonsoirs.com.
The Terms and Conditions are made available to customers on the Website where they can be consulted directly, and may also be provided upon simple request by any means.
The Terms and Conditions are binding on the customer, who acknowledges, by checking a box or clicking the designated button, having read and accepted them prior to placing an order. Confirmation of the order constitutes the buyer's acceptance of the Terms and Conditions in effect on the date of the order, the storage and reproduction of which are ensured by Bonsoirs Home.
Article 2 – PRODUCTS
www.bonsoirs.com is an online retailer of bed linen (hereinafter the "Product(s)"), open to any natural or legal person using the website www.bonsoirs.com (the "Customer").
The Products presented on the Website each include a description stating their essential characteristics. Photographs illustrating the products, where applicable, do not constitute a contractual document. The Products comply with applicable French law.
The Customer remains responsible for the terms and consequences of their access to the Website, including via the Internet. Such access may involve payment of fees to technical service providers such as Internet access providers, which remain the Customer's sole responsibility. Furthermore, the Customer must provide and be fully responsible for the equipment necessary to connect to the Website.
The Customer acknowledges having verified that their computer configuration is secure and in working order.
Article 3 – ORDERS
Bonsoirs Home strives to ensure optimal availability of its Products. Product offers are valid while supplies last.
If, despite Bonsoirs Home's best efforts, a Product proves unavailable after the Customer's order has been placed, Bonsoirs Home will notify the Customer by email as soon as possible, and the Customer will have the choice between:
Delivery of a Product of equivalent quality and price to the one originally ordered, or
A refund of the price of the ordered Product within no more than thirty (30) days of payment of any amounts already paid.
It is agreed that, beyond the refund of the unavailable Product's price if this option is requested by the Customer, Bonsoirs Home is not liable for any cancellation indemnity, unless the non-performance of the contract is directly attributable to Bonsoirs Home.
Except as otherwise stated in these Terms and Conditions and without prejudice to the statutory right of withdrawal, the Customer's orders are firm and final.
When placing an order, the Customer must select the chosen Products, add them to their cart by indicating the selected Products and desired quantities. The Customer may review the details of their order and its total price, and return to previous pages to correct the contents of their cart if necessary, before confirming it.
The Customer agrees to read the Terms and Conditions then in effect before accepting them and confirming the shipping terms, any applicable shipping costs, and the right of withdrawal prior to payment. Confirmation of the order constitutes acceptance of the Terms and Conditions and forms the contract.
Contractual information relating to the order (including the order number) will be confirmed by email in a timely manner and no later than at the time of delivery.
Any email sent to the Customer in connection with an order will be sent to the email address the Customer uses to log in to their customer account.
By providing their phone number at the time of ordering, the Customer is informed of their right, pursuant to Article L. 223-2 of the French Consumer Code, to register free of charge on the telephone canvassing opt-out list Bloctel (www.bloctel.gouv.fr).
Bonsoirs Home archives product sale contracts in accordance with applicable law. Upon request sent to hello@bonsoirs.com, Bonsoirs Home will provide the Customer with a copy of the contract in question.
Any modification of an order by the Customer after order confirmation is subject to Bonsoirs Home's approval.
The information provided by the Customer when placing the order (including name and delivery address) is binding on the Customer. Accordingly, Bonsoirs Home cannot be held liable in any way should an error made when placing the order prevent or delay delivery.
The Customer declares that they have full legal capacity to enter into commitments under these Terms and Conditions.
Registration is open to adults with legal capacity and to minors provided they act under the supervision of a parent or guardian holding parental authority. Under no circumstances may registration be made on behalf of third parties unless duly authorized to represent them (e.g. a legal entity). Registration is strictly personal to each Customer.
Article 4 – PAYMENT TERMS AND SECURITY
The Customer expressly acknowledges that any order placed on www.bonsoirs.com is an order with an obligation to pay, requiring payment of a price in exchange for the ordered Product.
In all circumstances, Bonsoirs Home reserves the right to verify the validity of payment, prior to shipping the order, by any means necessary.
Bonsoirs Home uses the following online payment solutions:
Adyen: for payments by credit/debit card, Apple Pay, and Twint (Switzerland)
Mollie: for payments via Bancontact, Belfius, and KBC/CBC (Belgium)
Payment by credit/debit card. Payment is made directly on the secure servers of the payment service providers (Adyen, Mollie); the Customer's banking details do not transit through the Website. Banking details provided at the time of payment are protected by SSL (Secure Socket Layer) encryption, and are therefore not accessible to third parties.
The Customer's order is recorded and validated upon acceptance of payment by the payment providers Adyen and Mollie.
The Customer's account will be debited the corresponding amount only when (i) the credit card details have been verified and (ii) the debit has been accepted by the card-issuing bank.
Inability to debit the amounts due will result in the immediate cancellation of the sale.
A credit card may be declined if it has expired, if the Customer's maximum spending limit has been reached, or if the entered details are incorrect.
Payment by PayPal and PayPal Pay. The Customer already holds a PayPal account and may use it to pay for their order securely without disclosing their banking details.
Article 5 – PRICING
Product prices are listed in euros (€) for all delivery countries except Switzerland, inclusive of VAT, and exclusive of shipping and handling costs. These prices include value-added tax (VAT) applicable in France or the tax applicable in the delivery country within the European Union.
Product prices are listed in Swiss francs (CHF) for deliveries to Switzerland, inclusive of VAT, and exclusive of shipping and handling costs. These prices include VAT applicable in Switzerland. Customs duties and other taxes are not included in the price. Customs clearance costs are borne by the Seller, Bonsoirs Home.
In the event of a promotion, Bonsoirs Home undertakes to apply the promotional price to any order placed during the promotional period.
The price is payable in euros (€) for all orders except those destined for Switzerland. The price is payable in Swiss francs (CHF) for orders delivered to Switzerland. The full price is due upon order confirmation. The prices offered include any discounts and rebates that Bonsoirs Home may grant.
If shipping or handling costs apply, they will be added to the Product prices and shown separately before the Customer confirms their order. The total amount due by the Customer and its breakdown are displayed on the order confirmation page.
Article 6 – CONTRACT FORMATION
The contract between Bonsoirs Home and the Customer is formed at the time the Customer sends confirmation of their order.
The Customer's attention is particularly drawn to the method of accepting orders placed on www.bonsoirs.com. When placing an order, the Customer must confirm it using the "double-click" technique: after selecting Products added to their cart, the Customer must review and, if necessary, correct the contents of their cart (identification, selected product quantities, price) and acknowledge acceptance of the General Terms and Conditions of Sale. They then click "Payment" to enter their personal details required for order processing before confirming by clicking "Continue to shipping method." They then select their delivery method and click "Continue to payment method." Finally, they confirm their order after entering their payment details. The "double-click" constitutes an electronic signature equivalent to a handwritten signature. It represents an irrevocable and unconditional acceptance of the order by the Customer.
Article 7 – RETENTION OF TITLE
Bonsoirs Home retains exclusive ownership of Products ordered on www.bonsoirs.com until full payment of the price has been received, including any applicable shipping costs.
Article 8 – SHIPPING AND DELIVERY
Online sales offers presented on the website are reserved for consumers residing in France or, where applicable, in a European Union member state, for deliveries within those same geographic areas.
Delivery refers to the transfer of physical possession or control of the Product to the Customer.
Orders placed on www.bonsoirs.com are prepared and shipped within a maximum of 48 hours (excluding Saturdays, Sundays, and French public holidays), provided that payment has not been previously declined. Shipments are then handed over to a logistics provider.
Delivery times are indicated in business days on the Website at the time of ordering. These timeframes include order preparation and shipping as well as the carrier's estimated delivery time.
The Customer is notified by email when their order has been shipped.
Packages are delivered to the address provided by the Customer at the time of ordering. It is therefore the Customer's responsibility to ensure that this address contains no errors. Bonsoirs Home cannot be held liable if an incorrect address provided by the Customer prevents or delays delivery.
If one or more Products cannot be delivered within the originally announced timeframe, Bonsoirs Home will send the Customer an email indicating the new delivery date.
A delivery receipt signature may be required upon delivery.
No delivery will be made to a P.O. box.
Shipping costs are those specified at the time of order completion and are accepted upon order confirmation.
→ Delivery to Metropolitan France and EU countries: Shipments are handled by a logistics provider (Colissimo, GLS, DPD, Chronopost, or Mondial Relay), which delivers the package to the address selected by the Customer at the time of ordering, whether at home, at a pickup point, or at one of the Bonsoirs stores.
→ Delivery to Switzerland: Packages are handled by Colissimo and then by FedEx upon arrival in Switzerland. Bonsoirs Home handles export customs formalities. As of April 11, 2024, customs clearance costs are borne by the Seller, Bonsoirs Home, and are no longer payable by the Customer to the carrier.
Upon delivery, it is the Customer's responsibility to verify that the Products received match their order and that the package is sealed and undamaged. If this is not the case, the Customer must indicate this on the delivery slip or send an email to hello@bonsoirs.com.
If after 5 business days the Customer has not received their order, they should contact the carrier responsible for their package. If the carrier's tracking service shows no record of the package, the Customer should send an email to Bonsoirs customer service, who will open a claim with the carrier.
Article 9 – RIGHT OF WITHDRAWAL, EXCHANGES, AND RETURNS
If a delivered Product does not fully satisfy the Customer, they may return it to Bonsoirs Home.
The Customer has thirty (30) days from receipt of the order to make a return. This period applies to all products; scented items (candles, diffusers, room mists, and scented ceramics) must be returned unopened and in their original packaging.
The Customer must send an email to hello@bonsoirs.com specifying the order number and the reason for the return. Bonsoirs Home will then send the Customer the return procedure for printing the return label. Return shipping costs are borne by Bonsoirs Home. Refunds (excluding original shipping costs) are processed within fifteen (15) business days of receipt of the returned package and will be automatically credited to the account associated with the credit card used for the purchase or to the PayPal account used for payment.
Bonsoirs Home's refund policy applies to private individuals only. For businesses, products that have been washed or used will not be accepted for return or exchange.
If the Customer made an error in size or color when placing their order, they may contact Bonsoirs Home to arrange an exchange. The Product must not have been washed or used by the Customer. The Customer has thirty (30) days from the date of receipt of the order to request an exchange. The Customer must send an email to hello@bonsoirs.com specifying the order number and the Product(s) to be exchanged. Bonsoirs Home will then send the Customer the return procedure for printing the return label. Once the Product(s) have been received, Bonsoirs Home will ship the new Product(s). Shipping costs are borne by Bonsoirs Home.
Products featuring embroidery are unique and personalized items. They cannot therefore be returned or exchanged, in accordance with Article L121-21-8 of the French Consumer Code: "The right of withdrawal cannot be exercised for contracts (...) for the supply of goods made to the consumer's specifications or clearly personalized..."
Curtain Products that have been altered cannot be returned or exchanged.
Any purchase made at Le Bon Marché may only be returned or exchanged at Le Bon Marché.
By accepting these General Terms and Conditions of Sale, the Customer expressly acknowledges having been informed of the exchange and withdrawal terms.
Article 10 – INTELLECTUAL PROPERTY AND LICENSE TO USE THE WEBSITE
Bonsoirs Home is the sole owner of all elements present on the Website, including without limitation all texts, files, animated or static images, photographs, videos, logos, drawings, models, software, trademarks, visual identity, databases, site structure, and all other elements of intellectual property and other data or information (hereinafter the "Elements"), which are protected by French and international laws and regulations relating to intellectual property.
Accordingly, none of the Elements on the Website may, in whole or in part, be modified, reproduced, copied, duplicated, sold, resold, transmitted, published, communicated, distributed, broadcast, displayed, stored, used, rented, or otherwise exploited, whether free of charge or for consideration, by a Customer or any third party, regardless of the means and/or media used, whether known or unknown to date, without the prior express written authorization of Bonsoirs Home on a case-by-case basis. The Customer is solely responsible for any unauthorized use and/or exploitation.
Bonsoirs Home reserves the right to pursue all available legal remedies against any person who fails to comply with the prohibitions set out in this article.
Article 11 – LIABILITY AND WARRANTY
Bonsoirs Home cannot be held liable for non-performance of the contract due to the Customer, or as a result of an event recognized as force majeure by the competent courts, or due to an unforeseeable and unavoidable act by a third party.
The Customer acknowledges that the characteristics and constraints of the Internet do not allow for guarantees regarding the security, availability, and integrity of data transmissions over the Internet. As such, Bonsoirs Home does not guarantee that the Website and its services will operate without interruption or functional errors. In particular, their operation may be temporarily interrupted for maintenance, updates, or technical improvements, or to evolve their content and/or presentation.
Bonsoirs Home cannot be held liable for the use of the Website and its services by Customers in violation of these Terms and Conditions, or for any direct or indirect damages that such use may cause to a Customer or third party. In particular, Bonsoirs Home cannot be held liable for misrepresentations made by a Customer or for their conduct toward third parties. In the event that Bonsoirs Home's liability is sought on account of such conduct by one of its Customers, that Customer undertakes to indemnify Bonsoirs Home against any judgment rendered against it, and to reimburse Bonsoirs Home for all costs incurred in its defense, including attorneys' fees.
Independently of any additional contractual warranty (commercial guarantee) that may be granted, the Products benefit from the legal warranty of conformity provided for in Articles L. 217-4 et seq. of the French Consumer Code (in particular Articles L. 217-4 to L. 217-14), and the warranty against hidden defects provided for in Articles 1641 to 1649 of the French Civil Code.
Article 12 – PERSONAL DATA
The User is hereby informed that the personal data indicated as mandatory on forms and collected in the context of the service described herein is necessary for use of the Website. Personal data that the Operator collects from the User may include:

Email address
Mailing address
Phone number
IP address (virtual address of their computer)
Password
Bonsoirs Home is committed to protecting the personal data of the Customer and all personal data obtained through the use of the Website's services.
In this regard, each Customer is solely responsible for maintaining the confidentiality of their login credentials and password, and is solely responsible for all access to their Customer Account, whether authorized or not.
Bonsoirs Home cannot be held liable for any harmful action or event carried out through the Customer's personal space by a third party who gained access to their credentials and password as a result of fault or negligence attributable to the Customer. The Customer agrees to notify Bonsoirs Home immediately upon becoming aware of or suspecting any unauthorized use or unauthorized access to their personal space.
All personal data collected by Bonsoirs Home is collected directly from the Customer and processed by Bonsoirs Home to enable the implementation and management of the Website's services. This data may also be used to compile statistics in order to improve the Website's services. This data may be shared with Bonsoirs Home's partners and suppliers involved in the delivery, invoicing, and order management process, as well as for marketing and customer relationship management purposes.
Bonsoirs Home complies with applicable personal data protection legislation. As the Website collects personal data, it has been the subject of a prior declaration with the CNIL, registered under number 2098919 v 0.

Article 13 – REFERENCES
The Customer authorizes Bonsoirs Home to mention the Customer's name and/or logo as a reference in its communications materials (brochures, website, commercial proposals, press relations, press releases, press kits, internal communications, etc.).
Article 14 – GENERAL PROVISIONS – ENTIRE AGREEMENT
These Terms and Conditions constitute a contract governing the relationship between the Customer and Bonsoirs Home. They represent the entirety of the rights and obligations of the Company and Bonsoirs Home with respect to their subject matter. If one or more provisions of these Terms and Conditions are declared void under any law, regulation, or following a final decision by a competent court, the remaining provisions will retain their full force and effect. Furthermore, the failure of either party to invoke a breach by the other party of any provision of these Terms and Conditions shall not be construed as a waiver of the right to invoke such a breach in the future.
Article 15 – COMPLAINTS AND DISPUTES
Consumer dispute mediation:
In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, the consumer is informed that they may have free recourse to a consumer mediator for the amicable resolution of any dispute with a business.
After first submitting a written request to Bonsoirs Home, and in the absence of a satisfactory resolution within a reasonable timeframe, the consumer may refer the matter to the following mediator:

Article 16 – REFERRAL PROGRAM
The Bonsoirs referral program allows Bonsoirs customers to receive a promotional discount by recommending Bonsoirs to their friends and family.
As a member of the Bonsoirs referral program (as a Referrer), you are required to be aware of and comply with the General Terms and Conditions of Sale and the terms specific to the referral program.
A referrer is a registered Bonsoirs customer who has already made at least one purchase on the website bonsoirs.com or in store.
A referee is a friend or family member of the referrer who has not previously purchased any item on bonsoirs.com or in store, and to whom the referrer shares their referral link. The referrer and referee cannot be the same person (including when two different email addresses are used).
The referral program entitles both the referrer and the referee to a €15 discount on all Bonsoirs products. Referral codes cannot be combined with each other in the same cart and cannot be combined with other promotional codes. A maximum of 20 referees may be referred.
The referral code for the referee applies only to their first order, upon creation of a new customer account.
Referral codes are valid for one month after issuance: at the time of the referral for the referee, and one month after the referred referee's first purchase for the referrer.
Bonsoirs reserves the right to review and suspend any account or order resulting from abusive or fraudulent behavior toward the referral program, such as attempting to obtain a discount by referring oneself using a different email address, or distributing a referral link through commercial advertising or spam.
By using the promotional offer, the referee acknowledges that certain personal information may be shared with the referring referrer — such as confirmation of the referee's purchase for the referrer to receive their discount. All personal data collected, processed, and used in connection with Bonsoirs' referral program will be used in accordance with Bonsoirs' Privacy Policy.

MODIFICATIONS TO THE TERMS
Bonsoirs Home reserves the right to modify at any time and without prior notice the content of the Website or the services available thereon, and/or to temporarily or permanently discontinue operation of all or part of the Website.
Furthermore, Bonsoirs Home reserves the right to modify at any time and without prior notice the location of the Website on the Internet, as well as these Terms and Conditions. The Customer is therefore required to refer to these Terms and Conditions before each use of the Website.
The Customer acknowledges that Bonsoirs Home cannot be held liable in any way toward the Customer or any third party for such modifications, suspensions, or discontinuations.
Bonsoirs Home recommends that the Customer save and/or print these Terms and Conditions for safe and lasting storage, so that they may be referred to at any time during the performance of the contract if needed.
APPLICABLE LAW
These Terms and Conditions are governed by, interpreted, and enforced in accordance with French law.
CUSTOMER ACCEPTANCE OF THE TERMS AND CONDITIONS
The Customer acknowledges having read these Terms and Conditions carefully.
By registering on the Website, the Customer confirms having read and accepted the Terms and Conditions, making them contractually bound by the terms herein.
The Terms and Conditions applicable to the Customer are those available on the date of the order, a copy of which dated as of that date may be provided to the Customer upon request. It is therefore specified that any modification to the Terms and Conditions made by Bonsoirs Home will not apply to any order placed prior to such modification, unless the Customer who placed the relevant order expressly agrees otherwise.
